A Florida attorney was arrested aboard a Norwegian Cruise Line ship after allegedly knocking an elderly man unconscious, authorities said, according to the NY Post.
Phillip Ortiz, 38, was on the Norwegian Encore when he was told he couldn’t enter a restricted hallway. Ortiz allegedly snapped back,
“Who the f—k are you to tell me what I can and can’t do,”
before shoving the 67-year-old man, according to an arrest report obtained by NBC Miami.
Police said the man pushed Ortiz and his wife away, triggering a fight. During the scuffle, Ortiz allegedly tripped the victim, causing him to fall and hit his head. The man lost consciousness, and witnesses began CPR after Ortiz walked off. Nurses and security staff responded, and the victim later regained consciousness before being taken to the University of Miami Hospital. Surveillance footage supported the accounts from the victim and witnesses, police said. Ortiz was arrested Saturday and charged with aggravated battery on a person 65 or older.
Ortiz pleaded not guilty on Sunday. His attorney, Stephan Lopez, argued the victim was drunk and blocking the couple from reaching their children.
“The so-called elderly person is bigger [and] stronger than my client,”
Lopez told People magazine.
“[He] was already drunk prior to the ship departing and he instigated and initiated the aggression amongst other things, assaulting my client’s wife and preventing access to their children 6 and 14 by, without authority, closing a door behind them and preventing access.”
Ortiz was released on bond on Monday and ordered to stay away from the victim.
