A Florida man was taken into custody for allegedly shooting and killing his stepson following a dispute over the popular video game Fortnite, as reported by PEOPLE.
On Wednesday, May 21, at around 7:10 p.m. local time, the Davenport Police Department (DPD) responded to a domestic disturbance at a residence on Citrus Landing Boulevard. Present at the home were 43-year-old # Kelly Agar Garcia, his wife 48-year-old Adriane Daza, her two young children aged 9 and 11, and her adult son, 26-year-old Azareel J. Martinez. Garcia is the stepfather to all three children, according to ABC Action News.
The 9-year-old had been playing Fortnite on a phone, despite his mother telling him he wasn’t allowed to do so, as reported by WSAZ and KOLD News 13. When she took the phone away, the child allegedly took a Smith & Wesson 9mm handgun from his mother’s nightstand. Daza was unable to take the gun away from her son. However, Garcia successfully did when he entered the room.
Argument Escalates to Gunfire
Police reported that 26-year-old Martinez intervened and began arguing with his stepfather. During this confrontation, Garcia allegedly shot him multiple times in the chest and abdomen, according to ABC Action News. As Martinez attempted to leave the room, authorities believe Garcia shot him two additional times in the back before he fell to the ground. The outlet stated that Martinez succumbed to his injuries after being transported to a nearby hospital.
Garcia is currently in custody at the Polk County Jail, facing charges of second-degree murder and unlawful storage of a firearm (accessible to a minor), as reported by PEOPLE based on inmate records. During a press conference on May 22, Parker mentioned that police had previously visited the family residence following a referral from the Florida Department of Children and Families in 2022.
