35-year-old Davidson received life support and was transported to a nearby hospital for treatment, says officials.

Criminal Who Reportedly Attacked An Elderly Man For Tripping Over His Foot Was Freed Without Bail

A man accused of assaulting an elderly man on a train in Lower Manhattan was released without bail, although he has a long arrest history, The New York Post reports. 44-year-old Johnson Earl, who has been apprehended 14 times, was recently charged with second-degree assault for brutally attacking the 83-year-old victim on Dec. 20 after the man accidentally bumped into his foot.

The following day, Judge Beverly Tatham granted him supervised release on the felony charge, despite prosecutors requesting $75,000 cash bail or a $100,000 bond to guarantee Earl’s “return to court,” said the Manhattan District Attorney’s Office.

He reportedly became furious on a southbound No. 5 train near Fulton Street station at about 6:10 a.m. when the victim tripped over his foot, according to officials and the DA’s office. Earl then struck the senior in the face, leading to a fight that ended with him putting the victim in a chokehold and hitting him further, said an assistant district attorney during Earl’s Jan. 2 arraignment.

The assault resulted in the victim suffering facial and head cuts, and he sought treatment at Kings County Hospital Center. Earl was most recently apprehended in July in the Bronx for repeatedly punching a security guard at a 99-cent store, as stated in the complaint. During that incident, he allegedly asked the victim, “Why are you not attending to me?” The case was “adjourned in contemplation of dismissal,” with no clear reason given, and the man was ordered to avoid contact with the victim, per Bronx prosecutors.
