Mondelez International, a snack food company, is suing Aldi, claiming that the packaging of Aldi’s store-brand cookies and crackers closely resembles its own products like Chips Ahoy, Wheat Thins, and Oreos. The lawsuit, filed in Illinois, argues that this could confuse customers and harm Mondelez’s brands. The company seeks damages and an order to stop Aldi from selling these products. Aldi has not yet commented on the lawsuit, according to the New York Post.
In the lawsuit, Mondelez showed photos comparing several products. For instance, Aldi’s Thin Wheat crackers are in a gold box similar to Mondelez’s Wheat Thins. Both Aldi’s chocolate sandwich cookies and Oreos use blue packaging, while Aldi’s Golden Round crackers and Mondelez’s Ritz crackers are in red boxes.
Aldi, discovered in Germany, keeps prices low by mainly offering its own label products. The supermarket has faced packaging lawsuits before, including a case in Australia where it was found to have copied the Baby Bellies snack puffs design.
In its lawsuit, Mondelez claimed it had reached out to Aldi several times about “similar packaging.” While Aldi changed some packaging, it still sold others. The lawsuit also states that Aldi violated Mondelez’s trade “dress rights” for Nutter Butter, Nilla Wafers, and Premium crackers packaging.
